Notice pursuant to Art. 13 of the European Regulation no. 679/2016 (GDPR)
This document has been prepared in accordance with the principles of EU Regulation 2016/679 (GDPR) on the protection of personal data (hereinafter referred to as the “Regulation”) with the purpose of allowing the users of the website www.fortgale.com (hereinafter referred to as the “Site”) to know its privacy policy, understand how their personal information is managed when using the Site and, if necessary, give their express and informed consent to the processing of their personal data.
The information and data provided by users, or otherwise acquired in the context of using the Site’s navigation services, will be subject to processing in compliance with the provisions of the Regulation and the confidentiality obligations that inspire the activity of Fortgale S.r.l. (hereinafter “Fortgale”).
According to the Regulation’s rules, the processing carried out by Fortgale will be based on the principles of lawfulness, fairness, transparency, limitation of purposes and retention, data minimization, accuracy, integrity and confidentiality, as well as the principle of accountability referred to in Art. 5 of the Regulation.
Specific security measures are observed to prevent data loss, unlawful or incorrect use, and unauthorized access.
1 – GENERAL INFORMATION
Users (hereinafter “Data Subjects”, ex. Art. 4, c.1 of the GDPR) are informed of the following general profiles, valid for all areas of processing:

2 – SPECIFIC INFORMATION
2.1 – Navigation data
This section describes the methods of managing the personal data acquired through this website (navigation logs and cookies) and the services connected to it, which involve user interaction.
The computer systems and software procedures used for the operation of this website acquire, during their normal operation, some personal data whose transmission is implicit in the use of Internet communication protocols. This is information that is not collected to be associated with identified data subjects, but which by its very nature could, through processing and association with data held by third parties, allow the identification of users. This category of data includes the IP addresses or domain names of the computers used by users who connect to the site, the URI (Uniform Resource Identifier) addresses of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters related to the user’s operating system and computer environment.
2.1.1 – Purpose and legal basis of the processing (GDPR Art.13, paragraph 1, letter c)
These data are used solely for the purpose of obtaining anonymous statistical information on the use of the Site and to verify its proper functioning. The data may also be used to ascertain responsibilities in the event of hypothetical computer crimes against the site (legitimate interests of the controller).
2.1.2 – Scope of communication (GDPR Art.13, paragraph 1, letters e, f)
The data are processed exclusively by authorized and trained internal personnel (GDPR Art. 29) and will not be communicated to external subjects, disseminated or transferred to non-EU countries. Only in the case of an investigation may they be made available to the competent authorities.
2.1.3 – Data retention period (GDPR, Art.13, paragraph 2, letter a)
The data are retained for a maximum period of 6 (six) months, except for any extensions related to investigative activities.
2.1.4 – Provision (GDPR, Art.13, paragraph 2, letter f)
The data are provided voluntarily by the Data Subject.
2.2 – Contacts
The optional, explicit and voluntary sending of electronic and/or postal mail to the addresses indicated in the “Contacts” section and/or through the form on this Site, involves the acquisition of the Data Subject’s address and any other personal data contained in the communication itself, in order to respond to the requests.
2.2.1 – Purpose and legal basis of the processing (GDPR Art.13, paragraph 1, letter c)
The personal data are sent by the Data Subject by filling in the appropriate fields provided. The data are processed with the consent of the data subject for the purpose of managing and responding to the requests received.
2.2.2 – Scope of communication (GDPR, Art.13, paragraph 1, letters e, f)
The data are processed by authorized and trained internal personnel (GDPR Art. 29) and will not be communicated to external subjects, disseminated or transferred to non-EU countries.
2.2.3 – Data retention period (GDPR-Art.13, paragraph 2, letter a)
The data are retained for the time necessary to process the request.
2.2.4 – Provision (GDPR-Art.13, paragraph 2, letter f)
The provision of personal data is optional, however, failure to provide data and consent to processing may make it impossible to properly evaluate the Data Subject’s request.
3 – COOKIES
3.1 – Cookie definition
Cookies are small text files that are sent to the Data Subject’s computer by the Site using the following types of cookies:
3.1.1 – Technical session cookies
The use of so-called session cookies is strictly limited to the transmission of session identifiers (consisting of random numbers generated by the server) necessary to allow safe and efficient browsing of the site. The so-called session
cookies used on this site avoid the use of other computer techniques that could potentially be detrimental to the confidentiality of the users’ browsing and do not allow the acquisition of the user’s personal identifying data. These
cookies are processed in computer mode.
There are also essential technical cookies necessary for the proper functioning of the website. These cookies allow to provide the services requested by users and to browse the site using its best performance. This type of cookie
cannot be disabled as it is necessary for the proper functioning of the site.
3.1.2 – Analytics cookies.
This website uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses “cookies”, which are text files placed on your computer to allow the website to analyze how users use the site.
The information generated by the cookie about your use of the website (including your IP address) will be transmitted in anonymous form and stored on Google’s servers in the United States. Google (independent data controller) will
use this information for the purpose of tracking and examining your use of the website. In particular, it is aimed at identifying which are the most viewed pages by users/visitors of the site, how long they stayed within it, the
geographical area of origin. This information is processed only for statistical purposes and in anonymous form. However, these cookies cannot be used for profiling or identifying specific users, but are used exclusively for statistical
purposes in aggregate form.
Google may transfer this information to third parties where this is required by law or where such third parties process the said information on Google’s behalf. Google will not associate your IP address with any other data held by

3.1.3 – Third-party profiling/advertising cookies
During navigation on the Site, the user may also receive on his/her terminal cookies from websites or web servers other than the Site (so-called “third-party” cookies): this happens because the Site may contain elements such as, for
example, images, maps, specific links to web pages of other domains that reside on servers other than the one on which the requested page is located. In other words, these cookies are set directly by managers of websites or servers
other than the Site.
These cookies can be sent to the user’s browser by third-party companies directly from their websites, which can be accessed by navigating from the Site. In such cases, Fortgale is completely extraneous to the operation of such cookies,
whose transmission falls within the responsibility of such third-party companies. As clarified by the Data Protection Authority: “The obligation to inform the user about the use of cookies and to obtain their prior consent, if necessary,
rests with the operator of the site that uses them, as the data controller. In the event that a site allows the transmission of “third-party” cookies as well, the information and acquisition of consent are normally the responsibility
of the third party. The user must be adequately informed, even if with the simplified procedures provided for by law, at the time of access to the site that allows the storage of third-party cookies, or when accessing the content
provided by third parties and, in any case, before the cookies are downloaded to his/her terminal.”
